# Failed the MOT? Retest Rules, the Free Window & Driving After a Fail (UK)

> **Quick answer:** Fail the MOT and your retest can be **free**: leave the car at the test centre for repair and it’s a free partial retest within **10 working days**; take it away and return by the **end of the next working day** and it’s free for a specific list of items; return within 10 working days and it’s a partial retest that can carry a reduced fee. As for driving home: a **dangerous** defect means the car doesn’t move; a **major**\-only fail with your old MOT still valid can legally be driven — but only while the car is actually roadworthy.

## The three retest situations

- **Car stays at the test centre:** repaired and partially retested within 10 working days — free.
- **You take it away, back by end of next working day:** free partial retest, but only for the listed quick items (wipers, mirrors, seatbelts, lamps and similar).
- **You take it away, back within 10 working days:** partial retest — the station may charge up to half the full fee.
- **Beyond 10 working days:** full test, full fee.

## Can you drive after failing?

- **Dangerous defect:** no. Driving it is an offence regardless of whether the old certificate is still in date.
- **Major defects, old MOT still valid:** the MOT position allows driving until the old certificate expires — but the Road Traffic Act still requires the car to be roadworthy, so a car with a failed braking component is not defensible.
- **Old MOT expired:** you may only drive to a pre-booked test appointment or to/from repair.

## Disagree with the result?

You can appeal a fail to DVSA (there’s a formal complaint route with a time limit) — don’t repair the disputed item before the appeal or the evidence goes with it.

## FAQs

**Does a fail cancel my existing MOT?**  
No — a certificate runs to its expiry date. But the failed defects are on the public record, and driving an unroadworthy car is an offence regardless of certificate dates.

**Is the retest at a different garage free?**  
No — the free/reduced windows only apply at the original test centre.
